Liability Notice

  • No Engineering or Sizing Responsibility
    • Used Solar Panel Sales does not engineer, recommend, or size photovoltaic (PV) systems and applications. Therefore, we are not liable or responsible for solar panels that are not sized correctly and subsequently purchased by you.
  • Use of Site and Products
    • You expressly agree that your use of, or inability to use, this site is at your sole risk. The site and all products and services delivered to you through the site are provided “as is” and “as available,” except as expressly stated by us, without any representations, warranties, or conditions of any kind, either express or implied. This includes, but is not limited to, all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
  • Warranty Claims and Manufacturer’s Obligations
    • You agree that we will not be liable, under any circumstances, for any breach of warranty claims or for any damages arising out of a manufacturer’s failure to honor its warranty obligations to you.
  • Indemnification
    • You agree to indemnify, defend, and hold harmless us, our affiliates, and our or their directors, officers, employees, agents, contractors, suppliers, service providers, and licensors, from any claim or demand, including reasonable attorneys’ fees and expenses, due to or arising out of:
      • (a) Your breach of these Terms of Service or the documents they incorporate by reference.
      • (b) Your violation of any law or the rights of a third party.
      • (c) The alleged failure or defect of any project built using products or publications purchased or otherwise obtained from us.
  • Responsibility for Safe Installation and Operation
    • It is your responsibility to be familiar with the safe and correct installation and operation of all equipment and other products. We have no opportunity or responsibility to inspect or supervise the design, manufacture, application, installation, or maintenance of the components or other products used, nor to supervise and inspect the design and manufacture of solar kits or other products in which they are used. By accepting delivery of products for solar power usage, you agree that all products will be used solely at your risk.
  • Limitation of Liability
    • In no event will we, our affiliates, directors, officers, employees, agents, contractors, suppliers, service providers, or licensors be liable for any indirect, incidental, special, or consequential damages of any kind. This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the site or any products or services procured using the site. This also includes any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the site or any content (or product or service) posted, transmitted, or otherwise made available via the site, even if advised of the possibility thereof. In no event will damages exceed the amounts paid to us under these Terms of Service. Some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so our liability will be limited to the maximum extent permitted by law in those states or jurisdictions.
  • Installation by Licensed Professionals
    • Solar panels, including those sold by Used Solar Panel Sales, are designed by the manufacturer to be installed and tested only by licensed, trained, and insured professionals following all local ordinances, codes, and regulations. Used Solar Panel Sales makes no warranty about the installation and disclaims all warranties, expressed or implied, including but not limited to any implied warranty with respect to the accuracy or completeness of the information disseminated and the fitness of the materials sold for a particular purpose. The purchaser of products from Used Solar Panel Sales agrees to fully indemnify Used Solar Panel Sales from any legal recourse relating to and arising out of the installation of the products purchased by the customer.
